MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on Tuesday, January 26, 2016, at 2:00 p.m., in Room 422 of the Governmental Center to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PROHIBITING EXTREME WELL STIMULATION FOR PURPOSES OF RESOURCE EXTRACTION ("FRACKING"); AMENDING SECTION 27-193 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

The proposed Ordinance was prepared by the Office of the County Attorney at the direction of the Board of County Commissioners at its meeting of November 10, 2015.

Summary Explanation/Background
Extreme well stimulation methods, such as hydraulic fracturing, acid fracturing, and cyclic steam injection (commonly referred to as "fracking"), are processes that pump large volumes of water mixed with other fluids and chemicals below the surface of the ground at high pressure to create fractures or weakness in oil- or gas-bearing geologic formations for the purpose of producing or recovering oil or gas, or to facilitate the mobility of oil and gas for extraction. Many of the chemical constituents injected have documented, adverse effects on human health and the environment, but the oil and gas industry is not required by federal or state law to publicly disclose the specific chemical formulas used in fracking. Because of the risks of groundwater, surface water, and soil contamination posed by fracking, Broward County currently opposes fracking in its federal and state legislative programs. This Ordinance addresses such risks at a local level by prohibiting the use of fracking methods within Broward County.
