    Question Parental Waivers

    Florida supreme court has now ruled that Parental Waivers are no longer valid in the state of Florida and children can also still not sing the waivers their selves. I was wandering about opinions on this from an active instructors point of view.

    It's not enough that adults can't be held responsible for themselves, now adults can't be held responsible for the actions of their kids.

    What a bunch of crap - "protecting the rights" of children. This is all about getting money out of a deep pocket, and abrogating any personal responsibility for one's (or one's childrens) actions.

    Yay for socialism, let the government interfere with how kids are handled. Do you know of any other states that are doing this?

    Waivers for minor children signed by a parent or legal guardian have been unenforceable for many years and many law suits were allowed to proceed. The court ruling allowed the case in question to proceed but emphasized "that our holding is narrowly directed at those commercial operators who wrongfully and negligently cause injury.” They affirmed what has always been the case just about everywhere. /K

    As Ken said.

    you can not sign away the rights of anyone except yourself, including your own children. you can sign that if anything happens to your child while in scuba class, you will not sue, but you can't sign off on your child's right to sue. And being minors they can't either.

    when you sign a liability waiver that says your family won't sue - same problem. you can't sign off on your spouse or kids or parents right to sue based on what happened to you.

    One of the best waivers I've seen was one that said something like "by signing you agree not to hold the charter responsible for accidents to you and if you or family members or friends sue on your behalf and win a settelment, that you agree that the full amount of the settlement will be paid from your estate." You can sign off on your estate!
