I love the CDF, it is very entertaining. We have gone on this post from the bad instructor to the unlawful use of photography without taking a breath. LOL

That doesn't even address the fact that CRITICISM is a specifically mentioned fair use in section 107 of the copyright act.
If your use of the image negatively affects the photographer, or his/her ability to use models (why would |I work with him? This other dude got hammered on CDS because someone didn't like the way his tanks were hanging in one of his photographs) then there's no criticism exception. Criticism in this context would be: "this photographer's composition is transformative to the genre". Not: "look at this bad instructor, no one should patronize him".

That's the photographer. You also have to be careful regarding the subjects of photographs. Running afoul of Right of Publicity and Misappropriation of Likeness regulations can put your ass in the defendant's chair too.

You can quote people in your book, and use references in your blog too. In sharing a post, you're basically telling people what channel the other person's tv show is on.

What's so hard about asking a photographer to use their work? Especially a fellow diver!

Not that marginal legal opinions on copyright law aren't very entertaining, but would anybody else mind if we went back to cave pictures that may or may not be related to missing deco bottles? Or could someone please pull a 2nd hijack on this thread and post a picture. I'm even open to poor quality Mexico pictures....

Cjay-- we are waiting on our Russian photographer and then we will be back in business!

He had bills to pay and a job to do.

We miss him, although I was beginning to whine we were being exploited.

He should at least buy beer after!

    Bob
