This just happened here in Flagler County. He probably had no intention at first so the actual flying was not for commercial purposes but the resulting footage did provide financial gain. 1. The FAA has no sense of humor.

2. The FAA decides what is and is not a violation of their own regulations. Any appeals of FAA decisions can be made to the FAA ONLY.
