I completely agree. The problem is you just can't win no matter what you do. Some people will say that's not enough and organizations should make it their priority to make sure member emails are up to date. People want to be spoon fed...
As for people who don't want the emails, services such as mailchimp provide the option for recipients to opt out or unsubscribe.

In spite of what those some people say, it is the responsibility of the customer to keep their contact data up to date.
How they do that, may be phone, snail mail, or a small app on a website.
