The diver that was with her was acting in good faith and did nothing wrong, she was in fact a victim of fraudulent behavior.

I would love to say that yes its all the fraudulent instructors fault. I an in no way attempting to decrease the seriousness of the situation or te bad this person has done.

But at the same time the diver who was pulled into upstream cow did not have the wher-with-all to realize where they were (supposedly). So yes the blame mostly falls on the instructor but it truly falls on both parties. I ensure i have all knowledge of a dive that i can have before i start it. I dont jump into trust me dives. Especially in a system that is protected by an agency. This diver ha shown a long and consistent disregard with warnings from others who have been concerned. The challenge incident and the "getting lost" in upstream cow were back to back incidents on consecutive days, and honesty was the final straw for many of us whom have tried to help or give advice (out of safety concerns).

So yes a good portion of the blame falls on this fraudulent individual. But at some point the blame has to fall on the second diver as well considering these issues have been consistent and continual.

At some point naivety needs to be learned from and corrected when it becomes either a safety concern for others that happen to be in the same system or the conservation of a prized site is threatened.

What part of 'the people that need to know, know what happened' is not clear? I don't see the point of trying to dig up dirt that is totally irrelevant to the OP's post. Unless of course you enjoy instigating things and then watching people get drug through the mud. I got a good lecture from my instructor regarding doing trust me dives amongst other things and that should be good enough for you too.

A few facts before wanna-be lawyers post bad info:

1) Libel is not a crime, its a civil matter and even if you were to prove Libel you still need to prove financial damages and that is hard to do unless you are a person of notoriety that can prove financial loss resulted from this specific act and thats hard to do even off you're Angelina Jole.

2) The phrase "anyone can sue anyone" is true but not accurate, there are significant financial consequences for people (and there attorney's) that bring "frivolous" lawsuits to court, this issue is becoming more and more significant due to backlogs.

3) In order to use the legal system to overwhelm someone you need money and a lot of it, no lawyer will take any case on a contingency basis unless winning is all but assured.

4) IF YOU ARE THE VICTUM OF A THEFT OR FINANCIAL CRIME: There are two ways to seek "justice" the first is initiating a civil case, I won't get into it but I would strongly avoid this since the perp can delay matters and then simply not pay when you win a judgement. The next is to try and initiate a criminal matter by filing a complaint and here's how to effectively go about this:

A) Try and contact the person you harmed you twice and document it.

B) Go to the jurisdiction of the offender and call 911 from a safe distance........many times this would be the residence of the offender and the victim might just call the authorities from a block or two away.

C) Simply state: I have been the victim of a larceny, I'm a block from the perpetrators house and I'd like to file a complaint", this will generate a quick response and obviously follow any instructions given to you.

D) Once the officer shows up....calmly explain exactly what happened, let to reporting PO know if there are any "other" victims, if there are any OTHER cases involving this perp. and where you believe these cases have been initiated, basically make there job as easy as possible.

E) follow up, EVERY week find out whats going on and give the investigators any "new info".

5) Circumstantial evidence is used every day in every court in America, here's why, if I tell you the sky is blue you may or may not believe me but if 4 people tell you the same story it gets real hard for you to disprove and even harder if all four sources are independent from different areas.

If the crime resulted in a financial loss then restitution is almost always apart of the "plea deal" or conviction after trial. A criminal judgement in most states does not expire and can't be attached to a BK filing so you are first in line to get paid, typically when a criminal agrees to pays restitution before they "plea" the case out the criminal gets a better deal and that makes sense because they made the victims whole up front.

Personally I would never contact law enforcement unless it was through an experienced criminal lawyer but do what you feel is necessary to get the justice you are entitled to.

I do see the relevance to the op and many of us do. But at this point your right. Maybe your instructors response will have sparked a change in your behavior so I'll keep fiuther details amongst us that know as i have been. If you would like any further clarification from any of us that know the details and the history as to why we're so fed up there are several off us that will happily set up a time to civilly discuss it at a dive site. Especially considering our original intent from when we first learned of your antics has been to get you to understand safety for yourself and others.

Ah your argument here is very weak, we are all responsible for ourselves when engaging in "high risk" activities, a fried of mine was killed skydiving a few weeks ago in a similar circumstance, but the diver was in COW because someone said they were a "GUIDE" and cave instructor through the technical level.......

It sounds like you have a personal relationship with the PERP? is that true?

All this cow stuff has squat to do with anything related to fraud and stealing. Pretty damn classless to even bring it up. Guess that's all cyber divers are really good for. Picking on new divers, get over yourself. I personally hooked her up for diving with this person as a good mentor. Not her fault things went the way it did. I knew the person in question for several years and didn't see this coming. I doubt any of you have anything to add as to the topic of this thread . If so great, nut the cow dive has nothing to do with it.

Sounds like TracyN trusted someone who falsely represented her qualifications as an instructor. The blame falls on the pseudo-instructor taking a diver on dives she should not have done. I believe that TracyN was unaware of this or she would not have posted about the dive in a public forum. She seems to be aware of the fault now and doesn't need any lectures by the keyboard instructors out there.
